Theo is a commercial litigator who has represented businesses and individuals in a range of complex and high-stakes litigations.  Theo is a graduate of Yale Law School, where he was a comments editor on the Yale Law Journal, an articles editor on the Yale Journal of Law & Technology, and a Coker Fellow in constitutional law.

Theo began his litigation career as an associate of Simpson Thacher & Bartlett LLP in New York, where his practice focused on complex civil litigation in state and federal court.

Before co-founding Chivers LLP, Theo was a law clerk to Judge Thomas L. Ambro on the U.S. Court of Appeals for the Third Circuit.

Selected Representations

Theo’s representative matters include:

  • advising the special committee of a real estate investment trust’s board of directors against a shareholder challenge to proposed acquisition;
  • advising an insurance claims management company regarding a contribution appeal before the New York Supreme Court, Appellate Division, First Department;
  • pursuing claims for “all sums” contribution on behalf of insurance company in the U.S. District Court for the Southern District of New York, the U.S. Court of Appeals for the Second Circuit, and the New York Supreme Court, First Department;
  • advising two non-profit organizations regarding challenge to federal surveillance of social media activity;
  • advising financial services company on potential liability under Florida veil piercing law;
  • representing more than 100 truck drivers in federal court wage-and-hour class action for breach of contract and violation of state and federal wage laws.
